1. Purpose and identification

These Terms and Conditions govern access to and use of the ACES Activa application, owned by ACES Europe (Company No. BE 0831.576.545, Rond Point Robert Schuman 6, Box 5, 1040 Brussels, Belgium). Use of the application implies acceptance of these Terms.

2. Description of the service

ACES Activa is a health, physical activity and civic participation application operating within the institutional framework of ACES Europe. It allows users to record and view their physical activity and health metrics, take part in the sporting life of their city and access gamification and event features. The application is free and contains no invasive advertising.

3. Informational nature; not a medical device

ACES Activa provides health and physical activity information for purely informational and wellness purposes. The application is not a medical device, does not provide diagnoses and does not replace the advice, diagnosis or treatment of a healthcare professional. Users should not make medical decisions based solely on the app's information and should consult a healthcare professional with any question regarding their physical condition.

4. Registration and account

The user is responsible for the accuracy of the data provided and for safeguarding their access credentials. The user must meet the minimum age required by the law of their country or, failing that, have the consent of their legal representative, in accordance with the Privacy Policy.

5. Proper use

The user undertakes to make lawful use of the application and not to use it for fraudulent purposes or in any way that may damage, disable or overload the service, or infringe third-party rights. ACES Europe may suspend or cancel accounts that breach these Terms.

6. Intellectual property

The contents, trademarks, logos and elements of the application, including the ACES award and identity, are owned by ACES Europe or its licensors and are protected by intellectual and industrial property law. The user retains ownership of the data they provide.

7. Availability and liability

ACES Europe seeks to ensure the continuous availability of the service, without guaranteeing the complete absence of interruptions. To the extent permitted by law, ACES Europe shall not be liable for damages arising from improper use of the application or from decisions made by the user on the basis of the information provided.

8. Amendments and applicable law

ACES Europe may amend these Terms, communicating substantial changes through the application. These Terms are governed by applicable law, with the parties submitting to the competent courts in accordance with consumer protection rules where applicable.
